General Terms of Use

  1. DEFINITIONS - "We", "Us", "Our" refer to eJay.
    "Services", "Website" means the buying, selling and marketing services provided by eJay.
    "You", "Your", "User" refers to yourself, or any person or entity utilising the services on your behalf.

    eJay reserves the right to modify or revise these Terms of Use and/or Privacy Statement or its other policies at any time at its sole discretion. Any such modifications shall be effective within fifteen (15) days of being posted on the Site. You are bound by such modification or revision, and should therefore visit this page frequently to review the terms. Your continued use of the Site following eJay's posting of any changes or modifications to these Terms of Use and/or Privacy Statement will constitute your acceptance of such changes or modifications. In the event that you do not agree to any changes or modifications of these Terms of Use and/or Privacy Statement, you should not continue to use the Site.
  2. ACCEPTANCE OF TERMS - Your use of the eJay website constitutes acceptance to all of the following terms and conditions. Should you disagree with any of the terms, your sole remedy is to discontinue any further use of the website.
  3. LIMITATION OF LIABILITY: This website is provided by eJay on an "As is" and on an "As Available" basis. To the extent permitted under the Law, Under no circumstances will eJay be liable for any losses (including, but not limited to, direct, indirect, incidental, punitive and consequential damages, or any damages related to the loss of property, loss of revenue/income, loss of business opportunities or loss of data/information), arising out of your use of, or inability to use the eJay website. eJay disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary or third party rights regarding the website.
  4. INDEMNITY - By using eJay you hereby release and forever discharge eJay, its subsidiaries, affiliates, co-brand partners or other partners, and their respective officers, directors, employees and agents free and harmless from and against all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses however arising out of your use of our services.
  5. PROVISION OF CORRECT INFORMATION & ELIGIBILITY - eJay only offer services to Users who are at least eighteen (18) years of age, and have the mental capacity to form legally binding agreements. You must provide correct information when registering. eJay reserves the right to terminate your account without notice should it believe you have provided incorrect information.
  6. GRANT OF ACCOUNT - eJay, on successful registration by the user, will grant the user access to the selling and buying facilities offered. Each individual must not register for more than one account. Multiple accounts registered by any one person may be terminated without notice.
  7. USER CONDUCT - Should eJay deem a registered user to be acting unlawfully, or unetically, eJay will suspend the user's account pending a full investigation. eJay also reserves the right to terminate accounts of users who threaten others. eJay will have the final discretion to terminate the user's account indefinitely or reinstate it. Due to privacy purposes, the results of the investigation cannot be disclosed.
  8. COMMUNICATIONS, T&C CHANGES - From time to time, eJay may send you eJay-specific information such as important changes to the website or these Terms and Conditions. Subject to your preferences, eJay will send via email, information pertinent to your selling or buying activities.
  9. PRIVACY - You agree to be bound by the terms set forth in the Privacy Policy.

Auctions and Fixed-price Sales Policy

  1. eJay is not an auctioneer, nor does it represent itself to be as such. eJay is an online, Internet venue for sellers and buyers to conduct sales. eJay will not enter into any correspondance in regards to any sales or transations made by sellers and buyers.
  2. Users must act lawfully at all times when using eJay. Users must not:
    • Make false or misleading statements about themselves
    • Sell or attempt to sell items which are illegal for trade, infringe on copyright, defame or denigrate individuals or organisations, not licensed for resale. See the Prohibited Item Policy for full details.
    • Mislead buyers about an item they are selling. This includes false claims about the item's condition, capabilities and false photos. See the Item Listing Policy for full details.
    • Threaten or harass other users. Harassment or personal threats may be referred to the police.
  3. Any listed item that is found not to comply with the above policies will be the subject of removal by eJay.
  4. All sales are final. Winning bidders are obliged to purchase the item from the seller, who is also obliged to sell the item to the buyer.
  5. Sellers must not place bids on items which they are selling.
  6. eJay cannot, and will not arbitrate any disputes between the seller and buyer.
  7. You may only list item(s) of which you actually own or have legal possesion of, or jurisdiction over (such as selling an item on behalf of a friend who has given you permission to do so).
  8. All item descriptions (Title, Description and Photos) are the sole responsibility of the seller. At no point in time will such descriptions form an opinion or be representative of any views of eJay
  9. Sellers are provided with the buyer's address after they have entered into a contract to purchase any item. Sellers are only permitted to use the buyer's address information solely for the purpose of allowing the seller to ship the item to the buyer. Any other use is expressly forbidden.
